The NATIONAL MUSEUM OF CONTEMPORARY ART (hereinafter ΕΜΣΤ) features the online store www.eshop.emst.gr through which it offers its customers the possibility of ordering unique works of art, on condition of the acceptance of these terms of use, which you are invited to read and revise carefully. By using eshop.emst.gr, the user declares their agreement with these terms and that they use eshop.emst.gr.

The use of eshop.emst.gr takes place with sole responsibility of the user. ΕΜΣΤ bears no responsibility for any kind of malicious interference by third parties.

Its users covenant to not harming any third parties by the malicious use of eshop.emst.gr as well as to not breaching their personal data. Visiting eshop.emst.gr prerequires the unconditional acceptance of these terms.

 

2. LIMITATION OF LIABILITY

 

The user agrees that the eshop.emst.gr service is used at their own responsibility and that the content is provided "as is" without guarantees of any kind, either direct or indirect and in particular without: a) guarantee for the uninterrupted provision of service of eshop.emst.gr b) guarantee for the availability, reliability, completeness or accuracy of the information of the service or the content, c) guarantee for the appropriateness for any specific purpose.

This limitation of liability clause applies to any damage resulting from failure to provide, error, omission, interruption, defect, delay in transmission or service, virus on the PC or any other electronic device, telecommunication connection failure, etc.

ΕΜΣΤ bears no responsibility for any legal or civil and/or criminal claims nor for any damage (positive, or consequential which indicatively and not restrictively, disjunctively and/or conjunctively consists of loss of profits, data, forgone revenue, monetary compensation etc.) by website visitors or third parties for a reason related to the functioning or non-functioning and/or use of the website and/or failure to provide services and/or information available from it and/or from any unauthorized interference by third parties with products and/or services and/or information available through it.

 

3. RIGHTS OF INTELLECTUAL PROPERTY

 

ΕΜΣΤ provides the user with access to the eshop.emst.gr service exclusively for personal use. The works of art sold on eshop.emst.gr are protected by legislation on intellectual property and neighboring rights. All content and information displayed, transmitted or transferred on the eshop.emst.gr service, including, but not limited to, the works of art for-sale, articles, texts, photographs, forms, and trademarks etc., are protected by legislation on intellectual property (in accordance with the relevant provisions of Greek law (Law 2121/1993), European law and relevant international conventions). ΕΜΣΤ, its partners, as well as the parties licensing it or advertised by it are in possession of the content. The user agrees that they will not modify, publish, transmit, sell, reproduce, distribute, display or commercially exploit in any way any content on eshop.emst.gr, as well as that they will by no means falsify the trademarks contained in this content in any way. The user is not entitled to modify the content, nor to modify or remove from the content any trademark, emblem or any other statement related to intellectual property rights.

 

The reproduction or storage of individual pages or data is allowed -under conditions- only for educational or research purposes, yet with the indispensable condition of their indication of origin by eshop.emst.gr as well as the explicit referral of the names of the creators, as long as this referral emerges from the eshop.emst.gr, without affecting in any way the relevant intellectual and industrial property rights. Nevertheless, users shall be aware that some files or data may constitute intellectual property of third parties (partnering bodies, organizations, companies, etc.), and may not be used without the permission of these third parties (which may be stated in the relevant indication of the eshop.emst.gr).

 

Content and information deriving from partners or third parties shall be distributed through the eshop.emst.gr service. All statements, offers or other information deriving from the above partners or third parties are deriving exclusively from them and not from ΕΜΣΤ.

 

4. USER REGISTRATION & IDENTIFICATION

 

User registration is not necessary in order to use the eshop.emst.gr service. In case the user wishes to register, they can do so by stating their first name, last name, a password and an e-mail. During registration, the user agrees to provide true, accurate, valid and complete information. In the event that the user provides untrue, inaccurate, obsolete or incomplete information, or in the event that ΕΜΣΤ retains reasonable suspicions that such information is untrue, inaccurate, obsolete or incomplete, ΕΜΣΤ is entitled to suspend or refuse the provision of the service. The user is responsible for keeping the user code secret and is also entirely responsible for all actions performed with their own user code. The user is obliged to immediately notify ΕΜΣΤ of any unauthorized use of their user code or of any other breach of security. ΕΜΣΤ is not responsible for damages or losses arising due to the fact that the user did not comply with their above obligations.

 

Along with the registration of the customer at eshop.emst.gr, they agree to receive the latest notifications and updates via email, which will be sent so as to inform them about the latest ΕΜΣΤ collections, as well as any other related news. Notwithstanding the above, the user of the service can inform about the termination of the automatic notification whenever they wish by modifying accordingly the relevant setting in the informational message they receive.

 

5. NEWSLETTERS

EΜΣΤ periodically sends informative emails to customers who have chosen it or who have provided their email in the context of our transactions with the online e-shop. ΕΜΣΤ is not responsible if the newsletters are not delivered to their destination, although it makes every effort with MSPs (Mail Service Providers) for delivery. Newsletters may end up in the spam folder, so please check regularly that they are not stored there. In this context, it is recommended to put the ΕΜΣΤ e-mail address eshop@emst.gr in your safe list.
In the event that you no longer wish to receive informative newsletters or wish to be completely unsubscribed from the ΕΜΣΤ newsletter system, you can at any time click on the unsubscribe link at the bottom of the newsletter.
ΕΜΣΤ uses a provider (3rd party company) for the identification (tracking) of the recipients of the newsletter. It does not hand over to third parties information about name, surname, residential address.
Similarly to email newsletters, ΕΜΣΤ also sends informative content via Viber and sms. Sending via Viber and sms is also ruled by the above terms. In case you wish to no longer receive informative messages via Viber or sms, you can always use the relevant link at the bottom of each message to unsubscribe.
ΕΜΣΤ makes every effort to update your preferences as soon as possible. However, sometimes there may be a slight delay, which may be due to systemic or force majeure reasons. For the above reasons, in case your request is not fulfilled immediately, please give us a 3-4 working days allowance.
 

6. USER RESPONSIBILITIES

The user agrees, declares and guarantees that they will use the online store eshop.emst.gr in accordance with the terms and conditions, lawfully and for legitimate purposes. Indicatively and not restrictively, the user declares that they will not use eshop.emst.gr:

• to harm minors

• to receive or transmit content that infringes intellectual property rights, confidential, pornographic, racist, threatening or in any way harmful content

• to transmit content that contains viruses capable of destroying or harming ΕΜΣΤ or other users

• for hacking or to transmit or deliver junk mail or chain letters or spam of any kind, pyramid letters or to otherwise prevent others from using the service or to harm or otherwise damage the image and reputation of ΕΜΣΤ or third parties

• to disclose sensitive or other type of personal data of themselves or third parties in related services.

 

7. PRICING POLICY

In all listed prices of the works of art put up for sale through eshop.emst.gr, the corresponding VAT is included, as provided by law until today.

8. APPLICABLE LAW

​

Any dispute between users and ΕΜΣΤ is governed by Greek Law and is subject to the exclusive competence of the Courts of Athens.

9. COMMUNICATION

​

For any information regarding the service, users of the service can send an email to  eshop@emst.gr.

ΕΜΣΤ is entitled at any time to modify, alter or delete one or all of these terms of use or to add new terms of use. Any such modification, alteration or deletion will be effective from its publication on the eshop.emst.gr service. By using the eshop.emst.gr service after the above publication, it is presumed that the user accepts every alteration, modification or deletion. ΕΜΣΤ reserves the right to alter, modify, suspend, prevent or cease the use of part or all of the eshop.emst.gr service at any time, for any reason or without reason, without notice and without bearing responsibility.
